Form I-9 Flexibilities Extension

Form I-9 and E-Verify

Effective on April 1, 2021 The Department of Homeland Security (DHS) issued temporary flexibility in the completion of Form I-9. Specifically, if employees were hired on or after April 1, 2021 and worked in an exclusive remote position due to COVID-19 precautions, were temporarily exempt from physical inspection of Form I-9 documents.

This temporary exemption exists until the employee undertakes consistent non-remote employment. Once normal operations/employment resumes, all remote employees must report to employer for document inspection within 3 business days.

The flexibility only applies exclusively to remote-work employees. If there are employees physically present at the employment location, no exceptions or flexibilities are allowed.
