What is considered credit history?
Any information related to the applicant or employee’s credit history and creditworthiness. That includes information gathered directly from the applicant/employee or gathered in a traditional manner like a credit check or a credit score.
Credit history information includes (but not limited to): missed and/or late payments, bankruptcies, liens, debts, judgments, collections, etc.
What are the exceptions?
An employer may use an applicant’s or employee’s credit history with the following exceptions: roles requiring clearance, specific roles in law enforcement, roles with access to trade secrets, roles with duties to modify digital security systems, roles requiring bonding, roles as required by the SEC, and roles that require public trust. This list is not all inclusive, please reference the legislation for a complete list.
